1. Who you are agreeing with
Dewiride Analytics is operated by Dewiride Technologies Private Limited, a company registered in India with its registered office at C/o Jagdish Kumawat, Village Tena, Tehsil Shergarh, Jodhpur 342028, Rajasthan, India. In these terms "we" and "us" mean that company, and "you" means the person or organisation holding the account.
You must be at least 18 years old, or the age of majority where you live, to hold an account.
2. What the service does
Dewiride Analytics measures traffic to websites you tell it about, classifies each visit, and shows you the result. It is a measurement and investigation tool.
Classifications are judgements formed from observed behaviour and published information. They are given with a stated strength of evidence and are not certainties. You should not treat a classification as proof of anybody's identity or intent, and you should not use one on its own as the sole basis for blocking, accusing or taking action against a person or organisation.
3. Your account
Keep your password to yourself and tell us promptly if you think somebody else has it. You are responsible for what is done through your account, including by people you invite to it.
You may add other people to your account and choose what each of them can do. Everything they do counts as done by you for the purposes of these terms.
4. Your websites and your data
You keep every right you already have in your websites and in the traffic data collected from them. We do not sell it, and we do not use one customer's traffic to build a product for another.
You must have the right to install measurement on every website you add, and you are responsible for telling your own visitors what is collected — our published summary of that is at analytics.dewiride.com/docs/privacy and you are welcome to draw on it.
In processing traffic data on your behalf we act on your instructions. What that means in practice, including how long anything is kept, is set out in the privacy policy.
5. Fair use
Do not use the service to break the law, to infringe somebody's rights, to attack or interfere with our systems or anybody else's, to work around your plan's allowance, or to resell the service as if it were your own.
Do not send us traffic data you fabricated, and do not use a server-side key to report visits that did not happen. The whole value of this product is that what it reports can be relied on.
6. Trials
New accounts get a free trial of 7 days with the whole product switched on. No card is taken and there is nothing to cancel — if you do nothing at the end of it, measurement simply stops and what you collected stays where it is.
7. Plans, prices and payment
Plans are monthly and are paid in advance. Prices are shown before you pay and are charged in Indian rupees for customers billed in India and in US dollars everywhere else. Which applies is settled from your billing address the first time you pay and does not change afterwards.
Rupee prices include goods and services tax at the rate in force. Dollar prices do not include any tax that may be due where you are, which is yours to account for.
Payments are taken by Stripe. We never see or store your card number. Changing a card, reading an invoice and cancelling all happen on Stripe's own pages.
If we change what a plan costs we will tell you at least 30 days before it affects you, and you are free to cancel in that time.
8. Allowances
Each plan covers a number of page views a month and a number of websites. Everything that reaches your website counts, including crawlers and automation — identifying them is the work you are paying for.
We write to you when you have used four fifths of a month's allowance. If you pass it, measurement continues for a further seven days and then stops until the month turns over or you move to a larger plan. Data already collected is never deleted for going over an allowance.
9. Cancelling
You may cancel at any time from inside the product. Your plan runs to the end of the period you have paid for and is not renewed. Refunds are covered by our refund and cancellation policy at analytics.dewiride.com/refunds, which forms part of these terms.
We may suspend or end an account that breaks these terms, that goes unpaid after we have written to you about it, or where we are required to. Where we end an account for a reason that is not your breach, we refund the unused part of anything you have paid in advance.
10. Getting your data out, and losing it
While your account is open you can read everything the product holds for you. After an account is closed we keep its traffic data for 30 days so that it can be restored if the closure was a mistake, and then delete it. Ask us before that runs out if you want a copy.
11. Availability
We work to keep the service running and to warn you before planned work. We do not promise that it will never be unavailable or never lose a measurement, and we do not offer a service level agreement on these plans.
12. What we are responsible for
The service is provided as it is. To the extent the law allows, we exclude warranties that are not written down here.
We are not liable for indirect or consequential loss, for lost profit or revenue, or for decisions taken on the strength of a classification. Where we are liable, our total liability for all claims in any twelve-month period is limited to what you paid us in that period.
Nothing here limits liability that cannot lawfully be limited.
13. Changes to these terms
We may change these terms. If a change materially affects you we will tell you by email at least 30 days beforehand, and you may cancel before it takes effect. Smaller changes are published here with a new date at the top.
14. Law and disputes
These terms are governed by the laws of India, and the courts of Jodhpur, Rajasthan have exclusive jurisdiction.
Please write to billing@dewiride.com about anything to do with a charge before asking your bank to reverse it — almost everything is quicker to fix directly. If we cannot settle it, escalate to grievance@dewiride.com within 30 days.
